1. PRESENTATION - by Friends of Camp Concord of $40,000 donation for the Recreation Activity Scholarship Fund. Report from Recreation Program Manager Steve Voorhies.
Staff Recommendation: Mayor Allen will accept the donation.
2. PRESENTATION - of Certificate of Support for the Healthy Families Program to Tony Etcheveste, President of the Mt. Diablo Education Association. Report from Mayor Allen.
Staff Recommendation: Mayor Allen will present the Certificate of Support.
3. PROCLAMATION - proclaiming May 16-22, 2004 as National Public Works Week in the City of Concord. Report from Mayor Allen.
Staff Recommendation: Mayor Allen will present the proclamation to Director of Public Works-Maintenance Services Qamar Khan.
4. PRESENTATION - on CALEA (Commission on Accreditation for Law Enforcement Agencies) Re-accreditation. Report from Police Chief Ron Ace.
Staff Recommendation: Alameda County Sheriff Charles Plummer will present the award to Mayor Allen, Police Chief Ron Ace and Lt. David Chilimidos.

Staff Recommendation: Adopt the Consent Calendar as recommended.
a. Matter to be set for public hearing - on Tuesday, May 25, 2004.
Metro Plaza Residential Subdivision Preliminary Development Plan (PD 03-005) - consideration of an application by Central City Investors for a Preliminary Development Plan to construct 100 single-family detached homes on a portion of a 9.9-acre site at the northeast intersection of Clayton Road and The Alameda, and adoption of a negative declaration with mitigation measures and monitoring program as the appropriate environmental document.; APN: 113-241-061, -063, -065, -066, and -079. Denial recommended by Planning Commission (3-1).
b. Awarding - contract for Project No. 176, Academy Road (North Side) Widening, to Sposeto Engineering, Inc. as the lowest responsible bidder in the amount of $120,897; waiving a minor defect in the bid proposal; and approving a related budget transfer of $98,000. Bids were opened on Wednesday, April 14, 2004 at 2:30 p.m. Recommended by the Director of Public Works - Engineering Services.
c. Designating - Vice Mayor Laura Hoffmeister as Voting Delegate to attend the League of California Cities' Special Meeting of the General Assembly on May 13, 2004 in Sacramento to brief the membership on the status of the Local Taxpayers and Public Safety Protection Act. Recommended by City Manager.

7. JOINT CITY COUNCIL/REDEVELOPMENT AGENCY CONSENT CALENDAR
Matters to be set for public hearing - on Tuesday, June 8 and Tuesday, June 22, 2004.
Approval of Fiscal Year 2004-05 Budgets for the City of Concord and Concord Redevelopment Agency, Redevelopment Agency Five-Year Implementation Plan, Ten-Year Financial Plan and Related Items - consideration of the following matters relating to the 2004-05 Budgets.
a. Proposed Amendments to the Master Fees and Charges Resolution - consideration of amending the Master Fees and Charges Resolution for fees relating to various municipal services, including but not limited to Administrative Fees; Business, Professional and Trades Fees; Parks and Recreation Fees; Permit Center Fees; Police Fees; and the Off-Site Street Improvement Program (OSIP) Fees. b. Annual Appropriation Limits and Adjustment Factors - approving annual appropriation limits and adjustment factors for Fiscal Year 2004-05, pursuant to Article XIIIB of the California Constitution.
c. 2004-05 City of Concord Budget, Ten-Year Financial Plan and Capital Improvement Program - consideration of Fiscal Year 2004-05 City of Concord Budget and Ten-Year Financial Plan, and adoption of the 2004-05 Capital Improvement Program.

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period
This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar
All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings
Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
