  1. PRESENTATION – of Certificates of Recognition to Lt. Joseph Gorton and Rick Boughton who in collaboration with the Diablo Valley Boys Ranch designed, built and installed concrete benches throughout the Concord community. Introduction by Councilmember Shinn.
  2. PRESENTATION – 2006 Monumental Toy Drive. Report by Lt. Jim Lardieri.
  3. ANNOUNCEMENTS
    1. ANNOUNCING - Two openings on Concord's Appeals Board, two openings on the Design Review Board, two openings on the Personnel Board and three openings on the Planning Commission, and setting Friday, January 5, 2007, as the deadline for receipt of applications. Recommended by City Clerk.

CITY COUNCIL MATTERS

  1. CITY COUNCIL CONSENT CALENDAR

    Staff Recommendation: Adopt the Consent Calendar as recommended.
    1. Approval of Minutes – of October 3, 10, 14, 16, 18, and 30, 2006. Recommended by City Clerk.
    2. Adopting - City Council Resolution 06-70 approving the appeal by Ray Keena and denying the Planning Commission's approval of ZAP 05-027 for the installation of a 50’6” tower to mount five amatuer radio antennas at 1755 Woodcrest Drive, APN 115-341-006. Public hearing held October 3, 2006.
    3. Approving – an amendment to the agreement with Magic Wave Productions, Inc. for video support services increasing the contract amount to $35,000, which requires Council approval, and authorizing the City Manager to execute the amendment. Recommended by Director of City Management.
    4. Accepting – the work performed by Metal Building Company to replace the gutters on the Fleet Garage in the Corporation Yard, RFB #2051, and directing the City Clerk to file the Notice of Completion. Recommended by Director of Public Works.
    5. Approving – an award of contract to remove, furnish, and replace the HVAC digital control system at Centre Concord, RFB #2074, to Cal-Neva Environmental Systems, of Concord , as the lowest responsible bidder in the amount of $25,985. Bids were opened on October 27, 2006 at 1:00 p.m. Recommended by Director of Public Works.
    6. Matter to be set for public hearing on Tuesday, November 28, 2006 and waiving the three week noticing period - COPS Grant – to consider the approval of the expenditure plan for the Fiscal Year 2006/07 Citizen’s Options for Public Safety (COPS) fund grant in the estimated amount of $242,198, to be used for front line municipal police services.
  2. CONSIDERATION - of appointments of resident and non-resident applicants to the newly formed Community Advisory Committee for the Concord Community Reuse Project for staggered one-year and two-year terms ending February 28, 2008 and February 28, 2009, respectively. Recommended by City Clerk.

  1. CITY COUNCIL PUBLIC HEARING
    1. Consideration of Amendment to the Concord Municipal Code - amending the Concord Municipal Code Chapter 2 (Administration), Article III (Officers and Employees), Division 2 (Compensation), Section 2-103, (Councilmembers), concerning adjustments to Council Compensation. Ordinance 06-13 required for introduction if changes are made. Report by Peter Dragovich, Director of City Management.

      Staff recommendation: Open public hearing, hear testimony, and if changes are desired, introduce Ordinance 06-13 by reading of the title only and waiving further reading.

JOINT CITY COUNCIL/
REDEVELOPMENT AGENCY

  1. JOINT CITY COUNCIL/REDEVELOPMENT AGENCY CONSENT CALENDAR
    1. Approving – a Certificate of Conformity between the Concord Redevelopment Agency and Rose Machado, owner of 1099 Reganti Drive, certifying that the property conforms to the Redevelopment Plan, and authorizing the Executive Director to execute the certificate. Recommended by Director of Planning and Economic Development.
    2. Matter to be set for public hearing on Tuesday, December 12, 2006 – Assembly and Development - to consider the assembly and development of an approximately 1.8 acre site located within the Central Concord Redevelopment Project Area on a site bounded by Clayton Road, Pine Street, Market Street and Willow Pass Road as a unified development by a master developer.; APN Nos. 126-291-010, 126-291-016, 126-291-017, 126-291-019, and 126-291-020.
    3. Approving - a $45,000 agreement with Bottomly Associates to provide design services for Project No. 2050, Downtown Streetscape Project, and authorizing the Executive Director to execute the agreement. Recommended by Director of Planning and Economic Development.

Notice to Public

Speaker's Card

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda Reports

Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
