CITY COUNCIL SITTING AS THE
LOCAL REUSE AUTHORITY

  1. LOCAL REUSE AUTHORITY CONSIDERATION ITEM:
    1. Consideration - of consenting to further postponement of the Navy’s issuance of a surplus determination for the Concord Naval Weapons Station (CNWS), so that alternatives to the Base Realignment and Closure (BRAC) Multi-Phase Planning Process adopted by the Concord Local Reuse Authority (LRA Resolution No. 06-2) to plan for the future civilian use of the CNWS may be provided by the Navy for City review. LRA Resolution 07-4 for adoption. Report from the Executive Director Lydia Du Borg.   Presentation by Department of Navy Representative, Principal Deputy Assistant Secretary Wayne Arny.

MATTERS

  1. CITY COUNCIL CONSENT CALENDAR
    1. Authorizing – the continuation of emergency action at Ygnacio Valley Road Landslide pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
    2. Confirmation of the Setting for Public Hearing on February 27, 2007 at 6:30 p.m. in the Council Chamber - an item regarding the development known as Jones Ranch which was set at the meeting held January 9, 2007 to consider an application by Winton Jones Development for a Preliminary Development Plan and certification of an Environmental Impact Report (EIR) for a new retail center that includes a 165,765 sq. ft. Lowe’s Home Improvement store, a 176,000 sq. ft. Wal-Mart, a 3,220 sq. ft. In-N-Out Burger restaurant with a drive-thru, and two additional sites for future retail on a 28.05-acre site at 1923-1985 and 2001 Arnold Industrial Way. The General Plan designation is Industrial Business Park ; Zoning classification is PD (Planned District); APN’s 159-090-013, -015, -024, 028, -030, -032, -034, and -036. This matter is recommended by the Planning Commission (4-0-1; Jensen absent). A Letter of Appeal dated January 25, 2007 submitted by Gregg Davidson, representing No More on 4, appealing the Planning Commission approvals and all other related actions regarding Jones Ranch Shopping Center (Planning Commission Resolution Numbers 07-02PC and 07-03PC, January 17, 2007) will also be considered.

  1. JOINT CITY COUNCIL/REDEVELOPMENT AGENCY CONSENT CALENDAR
    1. Approving – an agreement with Debra Nichols Design in the amount of $93,000 to prepare a Signage Program for entryway, wayfinder, and park signage for the City of Concord , and authorizing the City Manager/Executive Director to execute the agreement. Recommended by the Council Committee on Recreation and Cultural Affairs.
    2. Approving – a three-year agreement with Pacific Coast Farmers’ Market to continue operating a Certified Farmers’ Market at Todos Santos Plaza, and authorizing the City Manager/Executive Director to execute the agreement. Recommended by Director of Planning and Economic Development.
  2. JOINT CITY COUNCIL/ REDEVELOPMENT AGENCY CONSIDERATION ITEM
    1. CONSIDERATION – of a Request for Proposal for a business-oriented hotel to be built on a Pine Street Site consisting of five parcels located on the block bounded by Clayton Road , Pine Street , Market Street , and Willow Pass Road. Report by Helen Bean, Economic/Redevelopment Manager.

REDEVELOPMENT AGENCY MATTERS

  1. REDEVELOPMENT AGENCY CONSENT CALENDAR
    1. Approving – a Master Agreement for Professional Services with Diaz, Diaz & Boyd, Inc. in the amount of $50,000 to prepare property appraisals for the Redevelopment Agency; and authorizing the Executive Director to execute the agreement. Recommended by the Director of Planning and Economic Development.

Speaker's Card

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda Reports

Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
