City Council Matters

  1. CITY COUNCIL CONSENT CALENDAR
    1. Approving – a four-year capital lease with Cisco Systems Capital Corp. in the amount of $27,091.20 monthly for network equipment with the option for an additional one-year extension, and to authorize the Finance Director to execute the Master Tax-Exempt Lease/Purchase agreement and the City Manager to execute the Lease Agreement.  Recommended by the Director of Information Technology.
    2. Authorizing – the continuation of emergency action at Ygnacio Valley Road Landslide pursuant to Section 22050 of the Public Contract Code.  Recommended by Director of Building, Engineering and Neighborhood Services.
    3. Approving – a Master Agreement for Professional Services with Net.Works Corporation for software packaging and technology consulting services for Information Technology projects up to $100,000 per year through June 30, 2008, with the option of renew for two additional one-year terms, and authorizing the City Manager to execute the agreement.  Recommended by Director of Information Technology.
    4. Adoption of Ordinance 07-4 – Amendment to the Concord Municipal Code - amending Chapter 2 (Administration), Article VIII (Purchasing), Section 2-643 by adding bidding procedures under the Uniform Public Construction Cost Accounting Act (Public Contract Code Section 22000 Et. Seq.) Recommended by Director of Finance. Ordinance 07-4 introduced on July 10, 2007 by reading of the title only and waiving further reading.
    5. Adoption of Rezoning  Ordinance 07-425.1 – John Muir Medical Center Concord Campus Seismic Replacement and Upgrade Project (GP 05-006, RZ 05-003, PD 05-004, DP 05-002) - Application to amend the Zoning Map from the APO (Apartment and Professional Office) designation to Planned District (PD) for the 0.57 acre Kirk parcel.  Rezoning Ordinance 07-425.1 introduced on  July 10, 2007 by reading of the title only and waiving further reading.
    6. Matter to be set for Public Hearing -on Tuesday, September 4, 2007 at 6:30 p.m. in the Council Chamber – Proposed Amendment to the Concord Municipal Code - considering the amendment of Concord Municipal Code Chapter 14 - Buildings and Building Regulations, adding Article XVIII entitled Vacant Buildings, commencing at Section 14-535.  This hearing was previously set for July 10 and changed to July 24, 2007 but was not held.  Recommended by Director of Building, Engineering and Neighborhood Services.
    7. Matter to be set for Public Hearing - on Tuesday, September 11, 2007 at 6:30 p.m. in the Council Chamber - Appeal by T-Mobile - submitted by Mike Mangiantini, Project Manager for T-Mobile, of the Planning Commission's denial for a Zoning Administrator's Permit to replace a 30 ft. tall parking lot light pole with a 42 ft. parking lot light pole/monopole with three panel antennas, and add an 82 sq. ft. equipment enclosure to an existing enclosure at Dana Plaza Shopping Center locater at 4115 Concord Boulevard.
    8. Approving - a Joint Powers Authority by agreement to join the East Bay Regional Communications System and authorizing the City Manager to execute the agreement.  Recommended by Director of Information Technology.
    9. Approving - the notification of the California State Controller of the City of Concord’s election to become subject to the Uniform Public Construction Cost Accounting Procedures, as allowed under Public Contract Code Section 22030, et. seq.  07-55 for adoption.  Recommended by Director of Finance.
    10. Authorizing - the submittal of an application to the Association of Bay Area Governments and the Metropolitan Transportation Commission for potential planning and capital grant funding under the FOCUS Program.  Resolution 07-56 for adoption.  Recommended by Reuse Project Director.
    11. Awarding – a building demolition contract in the amount of $41,935 to Yelton Company, Inc. of Vacaville, CA as the lowest responsible bidder for Project No. 2062, Demolition of Properties located at 1701 & 1711 Concord Avenue (former Bob Brown Plumbing and Copper Kettle businesses).  Recommended by Director of Building, Engineering and Neighborhood Services.
  1. CITY COUNCIL CONSIDERATION ITEM:
    1. CONSIDERATION of two appointments to the Parks, Recreation, and Open Space Commission for two-year terms ending June 30, 2009; and one appointment for a one-year term ending June 30, 2008, for an alternate, if desired.  Report by the Council Committee on Recreation and Cultural Affairs.
  2. CITY COUNCIL PUBLIC HEARINGS:
    1. Concord 2030 Urban Area General Plan (GP 05-004) and Final Environmental Impact Report (State Clearinghouse No. 2006062093) – The General Plan document includes a new land use diagram and updates General Plan goals, principles and policies for the Economic Vitality; Land Use; Growth Management; Transportation and Circulation; Parks, Open Space and Conservation; Safety and Noise; and Public Facilities and Utilities Elements. Concurrent with the General Plan Update, the Zoning Ordinance will include a comprehensive review of land use regulations, development standards and review processes. The proposed General Plan Update may affect the permitted uses and development capacity of real property and will serve as a guide for development over the next 23 years, i.e., the period through 2030. Please note that the General Plan Update does not address the potential development of the Concord Naval Weapons Station because the City, acting as the Local Reuse Authority, has initiated a separate Base Reuse planning program that is currently in process. Recommended by Planning Commission. Report by Deborah Raines, Planning Manager.
    2. Vacation of portions of Almond Avenue and East Street, and two unnamed alleyways – consideration as a part of the John Muir Medical Center – Concord Campus Seismic Replacement and Upgrade Project, the vacation of approximately 23,465 square feet of a portion of Almond Avenue located between the west end of Port Chicago Highway and the east end of East Street, an approximately 10,000 square feet of a portion of East Street located between the south end of High School Avenue and the north end of Grant Street, an approximately 9,890 square feet of an Unnamed Alley located south of High School Avenue and terminating at the north end of previously vacated Bacon Street, and a portion of an Unnamed Alley approximately 6,770 square feet located at the south end of High School Avenue and terminating at the north end of a previously vacated Unnamed Alley pursuant to the Public Streets, Highways and Service Easements Law of 1980 Streets and Highways Code Section 8300 et seq., affecting Assessor’s Parcel Numbers 112-151-025, 112-162-043, -044 (Main Campus), and 112-152-014 to -017, -026 (South Property). Resolution 07-53 for adoption. Report by Alex Pascual, Director of Building, Engineering, and Neighborhood Services.
    3. Proposed Amendment to the Concord Municipal Code - Entertainment Permit – repealing in its entirety Chapter 6 (Amusements and Entertainments), Article VII (Entertainment Permits), Sections 6-191 through 6-205; repealing in its entirety Chapter 6 (Amusements and Entertainments), Article IX (Public Dances), Sections 6-261 through 6-275, and adding new Chapter 6 (Amusements and Entertainments), Article VII (Entertainment Permits) Sections 6-191 through 6-210. Public Hearing continued from July 10, 2007. Introduce Ordinance 07-8 by reading of the title only and waiving further reading. Report by Lt. Jim Larderi.

Redevelopment Agency

    1. JOINT CITY COUNCIL/REDEVELOPMENT AGENCY CONSENT CALENDAR:
      1. Approving – an allocation of funding in the amount of $374,740 from the Redevelopment Agency Housing Set-Aside Fund to Lutheran Social Services for the Mi Casa Project, a youth group home for up to six youth and an adult supervision located at 996 Oak Grove Road. City Council Resolution 07-57 and Redevelopment Agency Resolution 07-701 for adoption. Recommended by the Director of Planning and Economic Development.
      2. Approving – a Professional Services Agreement with Dyett & Bhatia in the amount not to exceed $190,000 to update the City’s Housing Element and authorizing the City Manager/Executive Director to execute required documents. This item was continued from the meeting of July 10, 2007 Recommended by Director of Planning and Economic Development.
    1. JOINT CITY COUNCIL/REDEVELOPMENT AGENCY PUBLIC HEARING:
      1.     1. REDEVELOPMENT AGENCY CONSENT CALENDAR:
      1. Approving – an agreement with Field Paoli in the amount of $195,800 to prepare an Urban Design Plan and Design Guidelines for the Monument Boulevard Corridor and authorizing the Executive Director to execute the agreement. This item was continued from the meeting of June 26, 2007. Recommended by the Director of Planning and Economic Development.
    2. REDEVELOPMENT AGENCY CONSIDERATION ITEM:
      1. Consideration - of the proposed design concepts for the City of Concord Signage Program. This item was continued from the meeting of July 10, 2007. Report by Helen Bean, Economic Development/Redevelopment Manager.

    1. LOCAL REUSE AUTHORITY CONSENT ITEMS:
      1. Approving – a professional services agreement with ARUP Inc. in an amount not to exceed $785,000 to conduct Stage 2 activities including refinement of the project description, impact analyses, preparation of an Administrative and Draft Environmental Impact Report (DEIR) on the Concord Naval Weapons Station Reuse Plan; and authorizing the Executive Director to execute the agreement amendment. Recommended by Reuse Project Director Michael Wright.

    Public Comment Period

    This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

    Consent Calendar

    All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

    Public Hearings

    Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

    Notice

    There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
