  1. CITY COUNCIL CONSENT CALENDAR
    1. Authorizing - the continuation of emergency action for Project No. 2034, Ygnacio Valley Road Landslide, pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
    2. Approving - a three-year service agreement with Sprint Solutions, Inc. in the total amount of $182,900 to provide cellular broadband data service for the next three years; and to authorize the City Manager to sign the agreement and any required amendments over the life of the agreement. Recommended by Director of Information Technology.
  2. CITY COUNCIL PUBLIC HEARING
    1. Consideration of an application by St. Bonaventure Catholic Community for a Preliminary Development Plan Amendment for a 16,528 sq. ft. addition consisting of 11,828 sq. ft. of meeting room space for existing religious classes and church programs, and a 4,700 sq. ft. administrative office building on their property located at 5562 Clayton Road. This application amends and supersedes the Preliminary Development Plan (PD 10-99) for a 44,500 sq. ft. addition and a private school with an enrollment of 385 students approved by the City Council in 2002. A Mitigated Negative Declaration is proposed. Also considered is an appeal submitted by Mike Cuddy, Concord, appealing the Planning Commission's approval (5-0) of a Use Permit Amendment for this application. Resolutions 08-3, 08-4, and 08-6 for adoption. Recommended by the Planning Commission. Report by Frank Abejo, Senior Planner.

      Staff Recommendation: Adoption of Resolution 08-3 confirming a Mitigated Negative Declaration; Resolution 08-4, adopting a PDP Amendment; and Resolution 08-6, Denial of the appeal submitted by Mike Cuddy.

  1. LOCAL REUSE AUTHORITY CONSENT ITEM:
    1. Approving - an amendment to the Professional Services Agreement with ARUP in an amount not to exceed $534,000 to conduct Stage 2 activities including refinement of the project description, impact analyses, preparation of an administrative and Draft Environmental Impact Report on the Concord Naval Weapons Station Reuse Plan. Recommended by Reuse Project Director.

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
