    1. Approval of Minutes - for the meetings of February 25, February 26 and March 4, 2008. Recommended by City Clerk.
    2. Authorizing - the continuation of emergency action for Project No. 2034, Ygnacio Valley Road Landslide, pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
    3. Adoption of Ordinance 08-2 - amendment to the Concord Municipal Code concerning Mobilehome Rent Stabilization, increasing automatic annual rent adjustments, permitting partial vacancy decontrol, and utilizing a third party hearing officer for special rent increase proceedings. Ordinance 08-2 introduced on February 26, 2008 by reading of the title only and waiving further reading.
    4. Approving - Project No. 2102, Hillcrest Park Creek Repair, and adopting the project plans.  Recommended by Director of Building, Engineering and Neighborhood Services.
    5. Accepting - the General Plan Progress Report and directing staff to submit the report to the Governor’s Office of Planning and Research and to the State Department of Housing and Community Development. Recommended by Director of Planning and Economic Development.
    6. Approving - a Professional Services Agreement with Parikh Consultants in the amount of $21,897 to provide geotechnical engineering services for Project No. 1283, Galindo Creek Trail Gap Closure; and authorizing the City Manager to execute the agreement. Recommended by Director of Building, Engineering and Neighborhood Services.
    7. Approving - the City’s Proposition 1B Expenditure Plan for Fiscal Year 2007-08. Resolution 08-15 for adoption. Recommended by Director of Building, Engineering and Neighborhood Services.
    8. Approving - Project No. 2101, I-680/Burnett Avenue Ramps Right-of-Way Close Out, and authorizing the allocation of $80,000 of OSIP Prior Citywide Funds to Project 2101. Recommended by Director of Building, Engineering and Neighborhood Services.
    9. Approving - Measure C I-680 and other related fund transfers associated with Project No. 2034 to meet obligations of a local match. Recommended by Director of Building, Engineering and Neighborhood Services.
    10. Approving - Professional Services Agreements with Kleinfelder, Inc. in the amount of $121,380; with Harris & Associates in the amount of $122,220; with EDAW, Inc. in the amount of $44, 450; with Cole Management, Inc. in the amount of $92,196; and with Gray-Bowen in the amount of $60,000 for professional services rendered for Project No. 2034, Ygnacio Valley Road Landslide; and authorizing the City Manager to execute the agreements. Recommended by Director of Building, Engineering and Neighborhood Services.
    11. Accepting - the improvements for Project No. 2094, Civic Center Lobby Improvements, constructed by Rodan Builders, Inc., of Belmont, CA; and directing the City Clerk to file a Notice of Completion. Recommended by Director of Building, Engineering and Neighborhood Services.
    12. Approving - a professional services agreement in the amount of $86,504 with Maze & Associates to provide independent auditing services for the year ending June 30, 2008; authorizing the option for auditing of the City’s financial statements for the next four fiscal years through 2012 at an amount not to exceed $379,228; and authorizing the City Manager to execute the agreements. Recommended by Director of Finance.
    13. Approving - an amendment to the professional services agreement with Gillarde Planning & Consulting in the amount of $20,000 which brings the total amount of the agreement to $40,000 and authorizing the City Manager to execute the amendment. Recommended by Director of Planning and Economic Development.
    14. Approving - Project No. 2103, Close Out of Iron Horse Gap Closure Bancroft / Hookston) Project; and Allocating $25,000 to the project. Recommended by Director of Building, Engineering & Neighborhood Services.
    15. Approving - an agreement in an amount not to exceed $35,000 in Fiscal Year 2007/08 for recruitment advertising services from Advance Recruitment Solutions and authorizing the City Manager to execute the agreement. Recommended by Interim Director of Human Resources.
    16. Awarding - a contract for the 2008 Slurry Seal Program, RFB #2121, to Valley Slurry Seal Company as the Lowest Responsible Bidder in the amount of $1,090,840.23; and approval of a related budget transfer of $110,000. Recommended by Director of Public Works.
  2. CITY COUNCIL CONSIDERATION ITEMS
    1. Consideration – regarding the petition to transfer territory from the Mt. Diablo Unified School District to the Walnut Creek School District and the Acalanes Union High School District. Report by Peter Dragovich, Director of City Management.

      Staff Recommendation: Adopt Resolution 08-18 opposing the transfer of territory to the Walnut Creek School District and the Acalanes Union High School District.

JOINT CITY COUNCIL/ REDEVELOPMENT AGENCY MATTERS

    1. Approving - an agreement with the Mt. Diablo Unified School District for the Improvement and Maintenance of Fence & Gates at Mt. Diablo High School, and appropriating $43,715 from Agency Unallocated Funds. City Council Resolution 08-17 and Redevelopment Agency Resolution 08-710 for adoption. Recommended by Director of Planning & Economic Development.

REDEVELOPMENT AGENCY MATTERS

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
