    1. Presentation - by Ruth Rodriguez, Director of the Monument Community First 5 Center. Introduction by Marla Parada, Recreation Program Manager.
    2. Presentation – by Dave Goldman, President of Friends of Camp Concord, of a donation in the amount of $63,000 for the Recreation Activity Scholarship Fund. Report by Christopher Roke, Recreation Program Manager.
    3. Presentation – to Qamar Khan, Director of Public Works, proclaiming May 18-24, 2008 as “National Public Works Week” in the City of Concord. Report by Director of Public Works.
  2. ANNOUNCEMENT

  1. CITY COUNCIL CONSENT CALENDAR
    1. Approval of Minutes - for the meetings of April 8, 2008. Recommended by City Clerk.
    2. Matters to be set for public hearing – Monday, June 23, 2008 – at 6:30 p.m. in the Council Chamber:

      (1) Rite Aid Store with drive through pharmacy - consideration of a Preliminary Development Plan for a 14, 546 sq. ft. Rite Aid Store with drive through pharmacy on a 1.53 acre site at 1990 Monument Boulevard located at the southwest corner of Monument Boulevard and Oak Grove Road. The General Plan designation is Commercial-Mixed Use, and the Zoning classification is Planned District. Recommended by Director of Planning and Economic Development.

      (2) ABBA Storage Appeal – submitted by Barry Silberman, ABBA Self & RV Storage, appealing the Planning Commissions’ April 16, 2008 denial of an application for a Use Permit Amendment to allow parking of recreation vehicles less than 8 feet in height along the east side of the property. Applicant states agreement to amend the application to meet the concerns of adjacent neighbors to the project site.
    3. Approving – a Professional Services Agreement with Teri Black & Company in the amount of $26,250 to conduct a recruitment for a Human Resources Director and; authorize the City Manager to execute the agreement. Recommended by Assistant City Manager.
    4. Awarding – a construction contract for Project No. 2087, Newhall Park Maintenance Building, to NORCAL Post and Frame Corporation of Roseville as the lowest responsible bidder in the amount of $97,186; and reject the bid protest from Antrim Construction. Recommended by Director of Public Works.
    5. Approving – the release and replacement of Parkland Funds with Proposition 1B and Gas Tax Funds for Project No. 1283, Galindo Creek Trail Gap Closure and Landslide Report. Recommended by Director of Building, Engineering and Neighborhood Services.
    6. Accepting – the Protective Net System constructed by Allied Investments under the terms of the Agreement approved January 8, 2008; and approving a related budget transfer from General Fund in the amount of $90,000 to credit Project 1833 which was temporarily used to process payment for the work completed to install the Protective Net System. Recommended by Director of Building, Engineering and Neighborhood Services.
    7. Approving – the Farm Bureau Road Drain Floodway/Floodplain Amendment Project and related funding in the amount of $43,000 to prepare a Letter of Map Revision to the Federal Emergency Management Agency advising of a watercourse alteration. Recommended by Director of Building, Engineering and Neighborhood Services.
  2. CITY COUNCIL PUBLIC HEARING
    1. 2008-09 Community Development Block Grant – Community Services Funding – consideration of accepting the Proposed Draft 2008-09 Action Plan containing the Community Services Commission's recommendations for community grant funding in all project categories from Federal Community Development Block Grant Funds, City of Concord General Fund, and Child Care Developer fees. Recommended by the Community Services Commission. Resolution 08-32 for adoption. Report from Community Services Manager, Teri House.

      Staff Recommendation: Approve 2008-09 Action Plan and adopt Resolution 08-32 approving community grant funding in all project categories as recommended by the Community Services Commission and contained in the Report to Council dated April 22, 2008.
    2. Proposed Amendment to Concord Municipal Code – City of Concord Retirement System – proposing to make numerous technical and clarifying revisions to Chapter 50, Article II of the Concord Municipal Code to properly reflect the previous change to the California Public Employees Retirement System, ensure compliance with current legal requirements, and promote ease of administration of the City of Concord Retirement System. Ordinance 08-4 for Introduction. Recommended by City Attorney.

      Staff Recommendation: Introduce Ordinance 08-4 by reading of the title only and waiving further reading.
  3. CITY COUNCIL CONSIDERATION ITEM
    1. Appointment of up to eleven members to the Commission on Aging, with up to six members to terms ending June 30, 2009, and with up to five members to terms ending June 30, 2010. Recommendation by the Council Committee on Neighborhood and Community Services.

      Staff Recommendation: Appoint up to six applicants to terms ending June 30, 2009, and up to five applicants to terms ending June 30, 2010.

REDEVELOPMENT AGENCY MATTERS

  1. REDEVELOPMENT AGENCY CONSENT ITEMS
    1. Approving – a Master Agreement for Professional Services in the amount of $50,000 with Diaz, Diaz and Boyd, Inc. to prepare property appraisals for the Redevelopment Agency. Recommended by Director of Planning and Economic Development.
    2. Matter to be set for public hearing – on Monday, June 23, 2008 – at 6:30 p.m. in the Council Chamber – in consideration of entering into a Lease Agreement with La Pinata of Concord, LLC (Restaurant) to occupy and use seventeen (17) parking spaces located on Agency owned property at 1948 Colfax Street, Concord, California, .13 acre of property (APN 126-074-014) between Willow Pass Road and Salvio Street. Recommended by Director of Planning and Economic Development.

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
