City Council Matters

  1. CITY COUNCIL CONSENT CALENDAR
    1. Approval of Minutes – for the special meeting of July 7, 2008, and the regular meetings of July 7 and July 14, 2008. Recommended by City Clerk.
    2. Authorizing – the continuation of emergency action for Project No. 2034, Ygnacio Valley Road Landslide, pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
    3. Authorizing – the acceptance of Justice Assistance Grant (JAG) funds in the amount of $16,694 and appropriating the funds to be used to partially fund the Police Department’s Family Violence-Victim Advocate position. Recommended by Chief of Police.
    4. Approving – an amendment of the Master Fees and Charges for Various Municipal Services Resolution to add the Certificate of Entitlement Reimbursement Fee to Section D of Exhibit “A” to Resolution 78-6042. Resolution 08-6042.3 for adoption. Recommended by Director of Finance.
    5. Awarding – a construction contract in the amount of $120,140.20 to American Engineering and Asphalt of Rocklin, CA, for Project No. 2081, Pave Loop Road at Camp Concord, Phase I; waiving a minor bid defect and adopting the project Plans and Specifications. Recommended by Director of Building, Engineering and Neighborhood Services.
    6. Awarding – a construction contract in the amount of $589,532.95 to Bay Cities Paving and Grading, Inc. of Concord for Project No. 2084, Clayton Road Pavement Rehabilitation (Willcrest Avenue to Latour Lane); and adopting the Project Plans and Specifications. Recommended by Director of Building, Engineering and Neighborhood Services.
    7. Approving – the transfer fee title of several parcels associated with Project No. 1149, Reconstruction of Concord Avenue/Route 242 Interchange, from the City of Concord to CalTrans; and authorizing the execution of a Quit Claim and Grant Deed as appropriate. Resolution No. 08-48 for adoption. Recommended by Director of Building, Engineering and Neighborhood Services.
    8. Awarding – a contract for Custodial Services, RFB #2112, Custodial Services, to Universal Building Services of Richmond in the amount of $61,026 as the lowest responsible bidder. Recommended by Director of Public Works.
    9. Accepting – grant funding in the amount of $198,126 from the State of California Office of Traffic Safety (OTS) for use in the City’s Driving Under the Influence (DUI) Enforcement, Awareness and Vehicle Impound Program. Recommended by Chief of Police.
    10. Approving – a Professional Services Agreement for Design Services with Debra Nichols Design in an amount not to exceed $27,500 for Project No. 2067, Gateway and Wayfinder Signage; and authorizing the City Manager to execute the agreement. Recommended by Director of Building, Engineering and Neighborhood Services.
    11. Approving – an amendment to the construction contract with Spencon Construction, Inc. in the amount of $364,987.95 for Project No. 2124, Citywide Sidewalk Improvement Annual Program (FY 2008/09); and approving related budget transfers totaling $419,562. Recommended by Director of Building, Engineering and Neighborhood Services.
  2. CITY COUNCIL CONSIDERATION ITEMS
    1. Consideration – of the appointment of three applicants to the Human Relations Commission for two-year terms ending June 30, 2010 and one alternate for a one-year term ending June 30, 2009 Report by the Council Committee on Recreation and Cultural Affairs.

      Staff Recommendation: Appoint three applicants to serve on the Human Relations Commission for a two-year term ending June 30, 2010.
  3. CITY COUNCIL PUBLIC HEARINGS
    1. Cowell Homeowners’ Association Appeal – Appeal of the Planning Commission’s denial of the Association’s appeal of a Zoning Administrator decision to require the preparation of an Environmental Impact Report consistent with requirements of the California Environmental Quality Act of 1970, as amended, for a Certificate of Appropriateness application to demolish the Cowell Smokestack at 4478 Lawson Court. The General Plan designation is Open Space; Zoning classification is Planned District; APN 133-260-002. Resolution 08-53 for adoption. This item was continued from the meeting of July 14, 2008. Report by City Attorney.

      Staff Recommendation: Adopt Resolution 08-53 making a finding of CEQA Emergency Exemption from the preparation of an Environmental Impact Report for the Cowell Smokestack, and referring the Certificate of Appropriateness application to the Planning Commission.
    2. Proposed Amendment to the Concord Municipal Code – Consideration of a proposed amendment to the Concord Municipal Code Chapter 14 (Buildings & Building Regulations), Article VI (Fire Code), Section 14-151 (Fire Code Adopted) to include the Contra Costa County amendments to the 2007 California Fire Code with modifications. Ordinance 08-6 for introduction. Report by Chief Building Official Vance Phillips.

      Staff Recommendation: Staff recommends continuation of this item to a date uncertain with full re-noticing.

JOINT CITY COUNCIL / REDEVELOPMENT AGENCY

  1. Joint City Council/Redevelopment Agency Consent Items:
    1. Approving – a Building Lease for 7,196 square feet of office and storage space for Engineering Services and Housing Division staff at 2151 Salvio Street, Suite 350; approving Project No. 2125, Engineering Services and Housing Division Relocation along with other appropriations; approving other related action; and authorize the City Manager to execute the Lease. Recommended by Director of Building, Engineering and Neighborhood Services.
    2. Approving – Business Terms for relocating the Masonic Temple and authorizing the City Manager to negotiate an agreement with the Concord Historical Society for the relocation of the Masonic Temple to the Galindo property and a related ground lease. Recommended by Director of Planning and Economic Development.

 


JOINT CITY COUNCIL SITTING AS THE LOCAL REUSE AUTHORITY / REDEVELOPMENT AGENCY

  1. Joint City Council Sitting As The Local Reuse Authority/Redevelopment Agency Consent Calendar:
    1. Approving – an amendment to the Professional Services Agreement with ARUP and authorizing the use of Redevelopment Agency funding in an amount not to exceed $125,000 to conduct Stage 3 activities including responding to requests for clarifications, modeling outputs and general comments on the Draft Environmental Impact Report on the Concord Naval Weapons Station Reuse Plan. Recommended by Reuse Project Director.
    2. Approving – an amendment to the Master Agreement with ARUP, Inc. and authorizing the use of Redevelopment Agency funding in an amount not to exceed $330,000 for professional services associated with the preparation of the Reuse Plan for the Concord Naval Weapons Station. Recommended by Reuse Project Director.

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
