- CITY COUNCIL CONSENT CALENDAR
- Approval of Minutes - for the special meeting of November 17, 2008 and regular meetings of November 24, December 1 and December 8, 2008. Recommended by the City Clerk.
- Accepting - City of Concord Redevelopment Agency’s State Controller’s Annual Report submittal as required by Section 33080 of the California Redevelopment Law Health and Safety Code. Recommended by the Director of Planning and Economic Development.
- Approving - an amendment to the agreement with Gerald Meckler in the amount of $4,500 to conduct five additional background investigations, increasing the total agreement price to not-to-exceed $29,500 for Fiscal Year 2008-09; and authorizing the City Manager to execute this amendment. Recommended by the Director of Information Technology.
- Accepting - the improvements for Project No. 2087, Newhall Park Maintenance Building, performed by Norcal Post and Frame Corporation of Roseville; and directing the City Clerk to file a Notice of Completion. Recommended by the Director of Public Works.
- Approving - an amendment to the Master Fees and Charges Resolution adding the Recreational Vehicle Storage Permit Fee to Section D (Permit Center Fees) of Exhibit A” to Resolution No. 78-6042. Resolution 09-6042.1 for adoption. Recommended by the Director of Building, Engineering and Neighborhood Services.
- Awarding - the annual contract to produce and deliver the Activity Guide, RFB #2167, to Fong & Fong Printers and Lithographers, as the lowest responsible bidder in the amount not to exceed $41,000. Recommended by the Director of Community and Recreation Services.
- CITY COUNCIL CONSIDERATION ITEMS
- Awarding - a construction contract in the amount of $41,750 to Brown & Fesler, Inc., of Livermore for Project No. 2123, Paw Patch Lighting Improvements at Newhall Community Park; and adopting the project plans and specifications. Report by Director of Building, Engineering and Neighborhood Services.
Staff Recommendation: Hear the report, award the construction contract and adopt the project plans and specifications. - Consideration - of the City of Concord’s current noise control measures, it is the results of a survey conducted of other agencies within Contra Costa County, and approaches to address noise problems in the City of Concord. Report by Director of Building, Engineering and Neighborhood Services. Report by Margaret Hernandez, Neighborhood Services Manager.
Staff Recommendation: Hear the report and provide staff with direction regarding the City’s noise control measures.

- CITY COUNCIL SITTING AS THE LOCAL REUSE AUTHORITY CONSENT CALENDAR
- Approving - a third amendment to the agreement with Katharine Gale Consulting to provide services related to the Homeless Accommodation for the Concord Reuse Project increasing the compensation by $30,000 to a total not to exceed $130,000 and extending the term to July 31, 2009; and authorizing the Executive Director to execute the agreement. Recommended by the Director of Planning and Economic Development.

Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.
Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar: All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
