Staff Recommendation: Adopt the Consent Calendar as recommended.- Approval of minutes - of the meeting held January 12, 2010. Recommended by City Clerk.
- Approving - an agreement with Terrapins Swim Team for a competitive swim program covering the period January 1, 2010 through December 31, 2012; and authorizing the City Manager to execute the agreement. Recommended by Director of Community and Recreation Services.
- Authorizing – the Contra Costa County Flood Control and Water Conservation District to establish an annual parcel assessment for Fiscal Year 2010-11 for drainage system maintenance and the National Pollutant Discharge Elimination System (NPDES) Program by maintaining the current Equivalent Runoff Unit (ERU) rate of $35.00 per single-family parcel. Resolution No. 10-1 for adoption. Recommended by Director of Public Works and Engineering.
- Accepting – the Comprehensive Annual Financial Report with Independent Auditors' Report and the Memorandum of Internal Control and Required Communications for the fiscal year ended June 30, 2009. Recommended by Director of Finance.
- Awarding - a construction contract in the total amount of $225,817.60 to Wingard Engineering, Inc. for Project No. 2110, Clayton Road/Chestnut Avenue Traffic Signal; and approving a related budget transfer in the amount of $70,000. Recommended by Director of Public Works and Engineering.
- Awarding - a contract to Republic ITS of Novato, in the amount of $15,560 for RFB #2191, Replace Traffic Signal Loops. Recommended by Director of Public Works and Engineering.
- Approving - agreement with MJL Enterprises to provide batting cage services at Willow Pass Park; and authorizing the City Manager to execute the agreement. Recommended by Director of Community and Recreation Services.
- Confirming - support of the Local Taxpayer, Public Safety and Transportation Protection Act of 2010. Resolution No. 10-7 for adoption. Recommended by Mayor Bjerke.
- CITY COUNCIL CONSIDERATION ITEMS
- Consideration - of the placement of a measure before the voters asking them to consider the question of whether the City Treasurer position should be appointed. Resolution Nos. 10-4 and 10-5 for consideration. (Item continued from the meeting of January 12, 2010) Report by Katharine Wisinski, Deputy City Attorney.
Staff Recommendation: Hear the report, take public testimony, and adopt Resolution No. 10-4 placing the measure before the voters on the June 10, 2010 ballot.

- Approving - amendments to the FY 2009-2010 Municipal Budget and Redevelopment Agency Budget respectively allocating savings from FY 2008-09 and other adjustments as outlined in the report. City Council Resolution No. 10-6 and Redevelopment Agency Resolution No. 10-741 for adoption. Recommended by the City Manager.

Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.
Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar: All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
