CITY COUNCIL MATTERS - CITY COUNCIL CONSENT ITEMS
Staff Recommendation: Adopt the Consent Calendar as recommended.- Approval of minutes - of the meetings held March 23, 2010.
- Setting of a public hearing - on Tuesday, May 11, 2010 in the Council Chamber - consideration of a draft five-year Consolidated Plan for 2010-15 as mandated by the Federal Department of Housing and Urban Development (HUD); an Analysis of Impediments to Fair Housing Choice; and the City of Concord's draft 2010-11 Action Plan, a subsidiary document of the five-year plan, containing the Community Service Commission's recommendation for Community Grant Funding in all project categories from Federal Community Development Block Grant Funds, City of Concord General Fund, and Child Care Developer fees. Recommended by City Clerk.
- Adoption of Ordinance No. 10-1 - a City-initiated amendment to the Concord Municipal Code concerning a Floodplain Management Ordinance proposing to repeal Chapter 34 in its entirety and adopt a new Chapter 34, updating standards for consistency with the California Model Floodplain Management Ordinance for Noncoastal Communities. Ordinance No. 10-1 was introduced by reading of the title and waiving further reading on March 23, 2010.
- Approving - a Mutual Non-Disclosure Agreement and an Energy Audit Agreement with Chevron Energy Solutions as an Energy Service Company (ESCO) to perform an audit of the energy usage in the City's facilities with the intent of having Chevron implement selected Energy Conservation Measures through a separate Energy Services Agreement (ESA). Payment of the energy audit cost of $140,000 to Chevron will be incorporated into the ESA and will come from the City's energy savings, which Chevron will guarantee as part of the ESA. This item was carried forward from prior meetings. Recommended by Director of Public Works and Engineering.
- Approving - a professional services agreement with Renne, Sloan, Holtzman, Sakai LLP to provide legal services in support of labor negotiations with employee bargaining units in amounts not to exceed $60,000 in Fiscal Year 2009 10 and if necessary $60,000 in Fiscal Year 2010-11; and authorizing the City Manager to execute the agreement. Recommended by Director of Human Resources.
- Accepting - the improvements for Project No. 2124, Citywide Sidewalk Repair, constructed by Spencon Construction, Inc. of Danville; and directing the City Clerk to file a "Notice of Completion." Recommended by Director of Public Works and Engineering.
- Approving - a professional services agreement with Lee and Ro, Inc., of Walnut Creek in the not-to-exceed amount of $24,990 to provide design services for Project No. 2148, Pump Replacement at Concord Community Pool; and authorize the City Manager to execute the agreement. Recommended by Director of Public Works and Engineering.
- Approving - a professional services agreement with Vali Cooper & Associates, Inc., of San Rafael in the not-to-exceed amount of $220,520 to provide construction management and inspection services for Project No. 2064, Monument Corridor Pedestrian Infrastructure Improvements; and authorize the City Manager to execute the Agreement. Recommended by Director of Public Works and Engineering.
- Awarding - a playground equipment and installation contract to Miracle Play Systems, Inc., in the amount of $133,584.72 for Project No. 2153, Ygnacio Valley Park Playground Equipment. Recommended by Director of Public Works and Engineering.
- Awarding - a contract in the amount of $32,000 to Apex Grading of Concord as the lowest responsible bidder for RFB #2199, 2010 Disc/Flail Mowing Program. Recommended by Director of Public Works and Engineering.
- CITY COUNCIL CONSIDERATION ITEMS
- Consideration - of a Quarterly Budget Update on the status of the City's budget and projections for the upcoming Fiscal Year. Report by City Manager Dan Keen and Director of Finance, Peggy Lefebvre.
Staff Recommendation: Hear the report, take public testimony, and provide direction to staff. - Consideration - of a report on the telephone survey conducted earlier this year, and on community outreach efforts concerning the ongoing budget crisis. CLOSED SESSION: The City Council may convene in closed session immediately prior to or at the conclusion of the above meeting. Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.
Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.
Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
